Paneristi.com Users Agreement

The following User Agreement ("Agreement") governs the use of Paneristi.com, including participation in all of its bulletin boards, or "forumsî as well as the use, in any form or manner, of any and all information, including, but not limited to opinions, resources, statements, requests, comments and transmissions. Please read the rules contained in this Agreement carefully. Your use of Paneristi.com will constitute your agreement to comply with these rules. If you cannot agree with these rules, please do not use and/or participate in any way on Paneristi.com. These rules may be modified by the Owners and Moderators from time to time; notice of revisions to this Agreement will be announced on this page. Continued access of Paneristi.com by you will constitute your acceptance of any changes or revisions to the Agreement.

Paneristi.com is intended to provide a forum for a robust and free-flowing exchange of information, opinions and comments related to everything Panerai, including, but not limited to Panerai watches and its products, history and ownership. Since Paneristi.com is designed to provide an enjoyable and informative experience for all participants, you agree to abide by certain rules regarding your participation. Your failure to follow these rules, whether listed below or in bulletins posted at various points on Paneristi.com by, and only by the Owners and/or Moderators, may result in termination of your access to participate on Paneristi.com, without notice, in addition to other remedies.

Paneristi.com is wholly owned by the following three individuals: Paddy, Jay, and Paul. Any and all of the expenses required to operate this site are shared by the owners and moderators. Paneristi.com has no affiliation with Officine Panerai, Richemont, or any watch dealer, retailer or vendor. Paneristi.com is a watch hobbyist site and conducts no business, other than the occasional charity fundraiser.

RULES OF USAGE

Comments by Users Are Not Endorsed by Paneristi.com, its Owners and Moderators.

Paneristi.com does not endorse, support, sanction, encourage, verify, or agree with the comments, opinions, or statements posted on bulletin boards or otherwise contained on Paneristi.com. Any information or material placed online, including advice and opinions, are the views and responsibility of those who post the statements, and does not necessarily represent the views of the Owners and Moderators of Paneristi.com.

Use of Paneristi.com by You

1) Your right to use the Paneristi.com is personal to you -- you may not authorize others to use Paneristi.com, and you are responsible for all use of Paneristi.com.

2) You agree not to use any obscene, indecent, or offensive language or to place on Paneristi.com any material that is defamatory, abusive, harassing, or hateful. Further, you may not place on Paneristi.com any material that is encrypted, constitutes junk mail or unauthorized advertising, invades anyone's privacy, or encourages conduct that would constitute a criminal offense, give rise to civil liability, or that otherwise violates any local, state, national or international law or regulation.

3) You agree to use Paneristi.com only for lawful purposes and you acknowledge that your failure to do so may subject you to civil and criminal liability.

4) You agree not speak on behalf of Paneristi.com, describe yourself as a Paneristi.com owner, moderator, employee or use Paneristi.com or any reference thereto on letterhead.

5) You are responsible for ensuring that any material you provide on Paneristi.com or post on a bulletin board, including but not limited to text, photographs, and sound, does not violate the copyright, trademark, trade secret or any other personal or proprietary rights of any third party or is posted with the permission of the owner(s) of such rights.

6) Material on Paneristi.com is for your personal use only. Paneristi.com contains copyrighted and other proprietary information. You may not in any way make commercial or other unauthorized use, by publication, re-transmission, distribution, performance, caching, or otherwise, of material obtained through the Paneristi.com, except as permitted by the Copyright Act or other law.

7) You agree NOT to do any of the following: (i) disrupt or interfere in any way with Paneristi.com; (ii) alter or tamper with any information or materials on or associated with Paneristi.com; (iii) affect the way Paneristi.com displays its pages, such as by framing Paneristi.com or placing pop-up windows over its pages; (iv) use any automated means to access the site or collect any information from the site; (v) use ActiveX, Java, Javascript, cookies, web bugs or tracking technologies (such as HumanClick or Sitemeter); (vi) collect any personal information about users on Paneristi.com including, but not limited to, their username or password; (vii) use emails tools (such as "Email this page") to send spam; (viii) publish or use files or processes that pose a threat to the proper technical operation of the system or to the security of other members; (ix) provide any content that contains viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.

8) You acknowledge that the Owners and Moderators of Paneristi.com have not reviewed the content of all sites linked to/from Paneristi.com and is not responsible for the content or actions of any other sites linked to/from Paneristi.com and does not endorse them. Your linking to Paneristi.com or any site linked thereto is at your sole risk.

Use of Material Supplied by You

Postings to and communications with any member, user, Owner, Moderator on Paneristi.com are not private. You grant Paneristi.com and its Owners and Moderators the unrestricted right to use, reproduce, modify, translate, transmit and distribute any material you supply or communicate to Paneristi.com (including your identity and information about you) in any medium (now in existence or hereafter developed) and for any purpose, including commercial uses, and to authorize others to do so.

Materials Posted by Others

You agree that Paneristi.com is not responsible, and shall have no liability to you, with respect to any information or materials posted by others, including defamatory, offensive or illicit material.
Indemnification

You agree to indemnify Paneristi.com and its Owners and Moderators, and to hold them harmless, from any and all claims and liabilities (including attorneys fees) which may arise from your submissions, from your unauthorized use of material obtained through Paneristi.com, or from your breach of this Agreement, or from any such acts through your use of Paneristi.com.

Editing and Deletions

The Owners and Moderators of Paneristi.com reserve the right, but undertake no duty, to review, edit, move, or delete any material provided for display or placed on Paneristi.com or its bulletin boards, in its sole discretion, without notice.

Posting Privileges

Paneristi.com reserves the right to revoke the posting privileges of any person or entity either temporarily or permanently. Revocations are within the sole discretion of the Owners and Moderators of Paneristi.com and are not subject to appeal or challenge. Revocations apply regardless of user, screen or entity name. Suspended users may not post or otherwise participate on Paneristi.com either directly or indirectly through entities, fictitious names, third parties, or otherwise. Posting for or on behalf of a suspended user is grounds for revocation of posting privileges. Continued participation on Paneristi.com.com by a suspended user may constitute a trespass, a violation of the user's ISP rules, or other civil and/or criminal violation(s), and Paneristi.com.com reserves the right to pursue any and all remedies against such violators, to report the matter to the user's ISP(s), and to refer such matters to local, state, and/or federal authorities, or to international authorities and authorities in the user's home country.

YOU ACKNOWLEDGE THAT YOU ARE USING PANERISTI.COM AT YOUR OWN RISK. PANERISTI.COM IS PROVIDED "AS IS", AND THE OWNERS AND MODERATORS OF PANERISTI.COM HEREBY EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF ACCURACY, RELIABILITY, TITLE, MERCHANTABILITY, NON INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER WARRANTY, CONDITION, GUARANTEE OR REPRESENTATION, WHETHER ORAL, IN WRITING OR IN ELECTRONIC FORM, INCLUDING BUT NOT LIMITED TO THE ACCURACY OR COMPLETENESS OF ANY INFORMATION CONTAINED THEREIN OR PROVIDED BY PANERISTI.COM. THE OWNERS AND MODERATORS OF PANERISTI.COM DO NOT REPRESENT OR WARRANT THAT ACCESS TO PANERISTI.COM WILL BE UNINTERRUPTED OR THAT THERE WILL BE NO FAILURES, ERRORS OR OMISSIONS OR LOSS OF TRANSMITTED INFORMATION, OR THAT NO VIRUSES WILL BE TRANSMITTED ON PANERISTI.COM.

THE OWNERS AND MODERATORS OF PANERISTI.COM SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTIES FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ALLEGEDLY SUSTAINED ARISING OUT OF YOUR ACCESS TO OR INABILITY TO ACCESS PANERISTI.COM, INCLUDING FOR VIRUSES ALLEGED TO HAVE BEEN OBTAINED FROM PANERISTI.COM, YOUR USE OF OR RELIANCE ON THE PANERISTI.COM OR ANY OF THE INFORMATION OR MATERIALS AVAILABLE ON PANERISTI.COM, REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

Termination

The Owners and Moderators of Paneristi.com have the right to terminate your ability to access Paneristi.com, for any reason, without notice.

Entire Agreement

This Agreement is the complete and entire agreement between the parties and supersedes any prior agreement, whether written or oral.
